General Terms and Conditions

1. Scope of Applicability
 

These General Terms and Conditions (GTC) apply to all orders placed through our online shop by consumers and entrepreneurs. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor independent professional activities. An entrepreneur is a natural or legal person or a partnership with legal capacity who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

These GTC also apply to future business relationships with entrepreneurs without the need for further reference. If an entrepreneur uses conflicting or supplementary general terms and conditions, their applicability is hereby denied; they will only become part of the contract if we expressly agree to them.
 

2. Contract Partner, Conclusion of Contract
 

The purchase contract is concluded with ME-Robotics - Atif Sarica. By placing products in the online shop, we provide a binding offer for the conclusion of a contract regarding these items. You can initially place our products in the shopping cart without obligation and correct your entries before submitting your binding order using the correction aids provided. The contract is concluded by clicking the order button, accepting the offer for the items in the shopping cart. You will receive a confirmation via email immediately after submitting your order.
 

3. Language of Contract, Storage of Contract Text
 

The language available for concluding the contract is German. We store the contract text and send you the order data and our GTC via email. You can view the contract text in your customer login.
 

4. Delivery Conditions
 

In addition to the listed product prices, shipping costs may apply. Further details regarding potential shipping costs can be found in the offers.
 

5. Payment
 

The following payment methods are generally available in our shop:

- **Prepayment:** We will provide our bank details in a separate email, and the goods will be delivered after payment has been received.

- **Credit Card:** By placing the order, you provide your credit card information. After verifying you as the legitimate cardholder, we will immediately request your credit card company to initiate the payment transaction. The transaction is automatically processed by the credit card company, and your card will be charged.

- **Invoice:** If you choose to pay by invoice, you do not need to be registered with PayPal. After a successful address and credit check and placing your order, we will assign our claim to PayPal. In this case, you may only settle the payment with PayPal. For payment processing via PayPal, in addition to our GTC, the terms and conditions and privacy policy of PayPal apply.
 

6. Retention of Title
 

The goods remain our property until full payment has been received. For entrepreneurs, we retain ownership of the goods until all claims arising from an ongoing business relationship are settled. You may resell the goods in the ordinary course of business; any claims arising from such resale will be assigned to us in advance, and we accept this assignment. You remain authorized to collect the claims; however, we may also collect claims ourselves if you fail to meet your payment obligations.
 

7. Transport Damages
 

For consumers: If goods are delivered with obvious transport damages, please report such errors to the carrier as soon as possible and contact us immediately. Failure to report or contact us will not affect your statutory claims and their enforcement, especially your warranty rights.

For entrepreneurs: The risk of accidental loss and deterioration passes to you as soon as we have handed the goods over to the carrier or other person designated to carry out the shipment. Among merchants, the duty to inspect and report under § 377 HGB applies. If you fail to notify us as required, the goods shall be deemed approved unless it concerns a defect that was not apparent during the inspection.
 

8. Warranty and Guarantees
 

Unless expressly stated otherwise, statutory liability for defects applies. When purchasing used goods, warranty claims are excluded if the defect occurs after one year from the delivery of the goods. Defects occurring within one year of delivery can be claimed within the statutory limitation period of two years. For entrepreneurs, the limitation period for warranty claims for newly manufactured items is one year from the transfer of risk. The sale of used goods is excluded from any warranty. 
 

9. Liability
 

For claims arising from damages caused by us, our legal representatives, or vicarious agents, we are liable without limitation in cases of injury to life, body, or health, intentional or grossly negligent breach of duty, warranty promises, or as far as the provisions of the Product Liability Act are applicable.
 

10. Dispute Resolution
 

The European Commission provides a platform for online dispute resolution, which can be found here: https://ec.europa.eu/consumers/odr/. Consumers have the option to use this platform for resolving their disputes.
 

11. Youth Protection
 

If your order includes goods subject to age restrictions, we ensure through a reliable procedure that the buyer has reached the required minimum age through personal identity and age verification. The delivery will only be made to the buyer personally after successful age verification.
 

12. Final Provisions
 

If you are an entrepreneur, German law applies, excluding the UN Sales Convention. If you are a merchant within the meaning of the Commercial Code, a legal entity under public law, or a public law special fund, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.
